1. Definitions

For the purposes of these Terms and Conditions:

• "Siam Nook" / "We" / "Us" — Siam Nook, a property rental advisory service operating from 42/3 Nimmanhaemin Road, Suthep, Mueang, Chiang Mai 50200, Thailand.
• "Service" — any of the rental advisory services offered by Siam Nook, including Neighborhood Discovery Rentals, Tailored Long-Term Search, and Tenant Advocacy Retainer.
• "User" / "You" — any individual who accesses our website, submits an enquiry, or engages us for services.
• "Agreement" — the contract formed between Siam Nook and a User upon confirmed engagement of a service.

2. Acceptance of Terms

By using our website or engaging any of our services, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are engaging services on behalf of a third party, you represent that you have authority to do so.

These Terms govern all interactions with Siam Nook unless a separate written agreement has been signed between the parties.

3. Service Description

Siam Nook provides property rental advisory services in Chiang Mai, Thailand. Our services are advisory in nature — we do not act as a landlord, letting agent, or legal representative. We assist tenants in finding and navigating rental accommodation and provide intermediary support during tenancy.

Services are available to individuals in Chiang Mai or planning to relocate there. We do not operate in other regions at this time.

4. User Responsibilities

When using our services, you agree to:

• Provide accurate and complete information about your needs, circumstances, and budget.
• Communicate promptly when a response is required to progress a search or arrangement.
• Not misrepresent your identity or circumstances to landlords or to Siam Nook.
• Use our services only for lawful purposes and in connection with genuine rental needs.

5. Intellectual Property

All content on the Siam Nook website — including text, neighbourhood guides, property descriptions, and design elements — is the property of Siam Nook and may not be reproduced, distributed, or repurposed without written permission.

You are granted a non-exclusive, non-transferable licence to access and use our website for personal, non-commercial purposes only.

6. Payment Terms

Service fees are as follows:

• Neighborhood Discovery Rentals: From ฿9,000 per week. Payment is required prior to stay commencement.
• Tailored Long-Term Search: ฿22,000 one-time fee. Payment is due upon confirmation of engagement.
• Tenant Advocacy Retainer: ฿3,800 per month. Payment is due monthly in advance.

Fees are payable in Thai Baht (฿). We reserve the right to adjust fees with reasonable notice. All payments are final unless otherwise agreed in writing. Where a search does not result in a signed lease, fees already paid are non-refundable.

7. Service-Specific Terms

Neighborhood Discovery Rentals: Properties are provided as described in the listing. Extension requests are subject to availability and must be made at least five days in advance. Early departure does not entitle a refund of the remaining period.

Tailored Long-Term Search: Includes up to five accompanied viewings. Additional viewings may be provided at our discretion. The service concludes upon lease signing or mutual agreement to end the search.

Tenant Advocacy Retainer: Covers the scope described in the service description. Siam Nook acts as an intermediary and cannot compel landlords to act, though we will make all reasonable efforts to facilitate resolution. The retainer may be cancelled with 14 days' written notice by either party.

8. Disclaimers

Siam Nook provides advisory services in good faith based on available information. We do not warrant or represent that any property will meet your expectations in every respect, that landlords will behave in any particular manner, or that any specific outcome will result from our assistance.

We are not a legal firm and do not provide legal advice. Any guidance provided in relation to lease terms is informational and should not substitute independent legal counsel.

9. Limitation of Liability

To the extent permitted by applicable Thai law, Siam Nook's liability for any claim arising from our services is limited to the fees paid by you in the preceding 60 days.

We are not liable for losses resulting from landlord actions, property conditions, third-party failures, or circumstances beyond our reasonable control.

10. Indemnification

You agree to indemnify and hold Siam Nook harmless from any claims, damages, or expenses arising from your misuse of our services, your breach of these Terms, or your interactions with landlords or third parties.

11. Termination

Either party may terminate an engagement with reasonable notice. Upon termination, any fees paid for services not yet rendered will be considered on a case-by-case basis. Siam Nook reserves the right to decline or discontinue services where a client has provided inaccurate information or engaged in conduct that makes continued engagement impractical.

12. Dispute Resolution

In the event of a dispute, both parties agree to attempt informal resolution through direct communication in the first instance. If resolution cannot be reached within 30 days, disputes shall be subject to the jurisdiction of the courts of Chiang Mai, Thailand, under Thai law.

13. General Provisions

These Terms constitute the full agreement between you and Siam Nook with respect to their subject matter. If any clause is found to be unenforceable, the remainder of the Terms shall continue to apply. Failure to enforce any provision does not constitute a waiver of that right.

14. Changes to These Terms

We may update these Terms from time to time. Significant changes will be noted on this page with a revised "Last Updated" date. Continued engagement with our services following any update constitutes acceptance of the revised Terms.
